Welcome to ANYSTAT ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the ANYSTAT platform, website (anystat.ai), and all related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

By using ANYSTAT, you represent that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• Your use of the Service complies with all applicable laws and regulations
• All information you provide is accurate, current, and complete

ANYSTAT is a statistical data visualization platform that allows users to:

• Create interactive charts and data visualizations
• Share and embed visualizations publicly
• Browse publicly available chart galleries
• Generate AI-powered charts and visualizations
• Compare multiple datasets and statistics

3.1 Account Types

We offer three types of access:

• Guest Users: Can create and view charts without registration
• Registered Users: Authenticated users with full platform access
• Premium Users: Users with paid AI feature subscriptions

3.2 Authentication Methods

You may create an account through:

• Email registration with email verification
• Google OAuth authentication
• Other third-party authentication providers we may offer

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your authentication method (email, Google account) remains secure

3.4 Third-Party Authentication

When using OAuth or third-party authentication:

• You grant us permission to access basic profile information from the third-party provider
• You are subject to the third-party provider's terms and privacy policies
• We are not responsible for the third-party provider's actions or data practices
• You may revoke third-party access at any time through your provider's settings

4.1 AI Chart Generation

Our AI-powered chart generation service allows you to create visualizations using artificial intelligence. This feature operates on a credit-based system:

• Free Tier: 3 free AI chart generation requests per account
• Premium Tier: Unlimited AI chart generation for $10.00 USD per account

4.2 AI Credit System

• Free credits are non-transferable and non-refundable
• Free credits expire if unused within 12 months of account creation
• Premium subscriptions renew automatically unless cancelled
• AI-generated content quality may vary based on input data and prompts
• We do not guarantee specific outcomes or accuracy of AI-generated charts

4.3 AI Usage Restrictions

You agree NOT to use AI features to:

• Generate misleading, fraudulent, or deceptive visualizations
• Create content that violates intellectual property rights
• Generate charts for illegal activities or purposes
• Attempt to reverse engineer or abuse the AI system
• Generate excessive requests to circumvent usage limits

5.1 Premium Subscriptions

• Premium subscriptions are billed monthly at $10.00 USD
• Payment is processed through our third-party payment provider (Paddle)
• Subscriptions auto-renew unless cancelled before the renewal date
• You authorize us to charge your payment method for recurring fees

5.2 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial months or unused credits
• We reserve the right to modify pricing with 30 days' notice

5.3 Payment Processing

• All payments are processed securely through Paddle
• We do not store your complete credit card information
• Failed payments may result in service interruption
• You are responsible for all applicable taxes

6.1 Your Content

You retain ownership of all data, charts, and visualizations you create ("User Content"). By using our Service, you grant us:

• A worldwide, non-exclusive, royalty-free license to host, display, and distribute your User Content
• The right to display your public charts in our gallery and search results
• Permission to allow other users to embed your public charts
• The right to use your public content for platform promotion and marketing

6.2 Public vs. Private Content

• Public Charts: Visible in our gallery, searchable, and embeddable by others
• Guest Charts: Created without login, automatically public
• All charts include watermarks when embedded
• You are responsible for ensuring you have rights to any data you upload

6.3 Platform Content

All platform features, design, code, and branding are owned by ANYSTAT and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our platform code or design
• Remove or modify any copyright notices or watermarks
• Use our trademarks without written permission
• Scrape or extract data using automated tools

6.4 AI-Generated Content

• You own AI-generated charts created through our service
• AI-generated content is subject to the same public/private rules
• We are not liable for copyright issues arising from AI-generated content
• You are responsible for verifying accuracy of AI-generated visualizations

7.1 Google AdSense

Our Service displays advertisements through Google AdSense. By using our platform:

• You acknowledge that ads may be displayed throughout the Service
• Google may use cookies and tracking technologies for ad personalization
• You are subject to Google's advertising policies and terms
• We earn revenue from ad impressions and clicks

7.2 Ad Blocking

• We request that you disable ad blockers to support our free service
• Ad revenue enables us to provide free chart creation and hosting
• Premium users may experience fewer or no advertisements (future feature)

8.1 Embed Functionality

• All public charts can be embedded on external websites
• Embedded charts include ANYSTAT watermarks and attribution
• You may not remove watermarks or modify embed code to obscure attribution
• Embedded charts remain hosted on our servers
• We reserve the right to disable embeds that violate these Terms

8.2 Viral Sharing

• Charts may be shared via direct links, social media, or embed codes
• Sharing does not transfer ownership or rights
• Original creators maintain control over shared content

You agree NOT to:

• Violate any laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Create misleading or fraudulent visualizations
• Impersonate others or misrepresent affiliations
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or harvest data using automated tools
• Interfere with or disrupt the Service
• Use the Service for spam or unsolicited communications
• Circumvent usage limits or payment requirements
• Resell or redistribute our Service without permission
• Upload content that violates intellectual property rights
• Create content that is illegal, defamatory, or obscene

10.1 Data Collection

We collect and process personal data as described in our Privacy Policy, including:

• Account information (email, name, OAuth profile data)
• Usage data (charts created, features used, AI requests)
• Payment information (processed by Paddle)
• Analytics and advertising data (Google AdSense, Google Analytics)

10.2 GDPR Compliance

For users in the European Economic Area:

• We process data lawfully under GDPR Article 6(1)(b) for service delivery
• You have rights to access, rectify, erase, and port your data
• You may object to processing or withdraw consent at any time
• Data is stored securely and retained only as long as necessary
• You may lodge complaints with your local data protection authority

10.3 Data Security

• We implement industry-standard security measures
• However, no system is 100% secure
• You use the Service at your own risk
• We are not liable for unauthorized access despite our security efforts

11.1 Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or availability of the Service
• Uninterrupted or error-free operation
• Accuracy of AI-generated content or visualizations
• Security of data or protection against unauthorized access

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid in the past 12 months (or $100 USD if greater)
• We are not liable for third-party actions (OAuth providers, payment processors, advertisers)
• We are not liable for user-generated content or AI-generated output
• We are not liable for data loss, business interruption, or lost profits

11.3 No Professional Advice

• Our Service provides tools for data visualization, not professional advice
• Charts and statistics are for informational purposes only
• You should verify all data and consult professionals before making decisions
• We are not responsible for decisions made based on platform content

You agree to indemnify, defend, and hold harmless ANYSTAT, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Your use of AI-generated content

13.1 Termination by You

• You may delete your account at any time through account settings
• Cancelling premium subscriptions does not delete your account
• Deletion is permanent and cannot be undone

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for over 24 months
• Required by law or legal process
• We discontinue the Service

13.3 Effect of Termination

• You lose access to your account and premium features
• Public charts may remain accessible in our gallery
• No refunds for unused subscription time or credits
• Sections of these Terms that should survive (liability, indemnification) remain in effect

• We may modify these Terms at any time
• Material changes will be announced via email or platform notice
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the Service

• We may modify, suspend, or discontinue any feature at any time
• We are not liable for any modification or discontinuation
• Premium features may be added or removed
• Pricing may change with 30 days' notice

16.1 Governing Law

These Terms are governed by the laws of Azerbaijan, without regard to conflict of law principles.

16.2 Dispute Resolution

• Any disputes shall first be resolved through good-faith negotiation
• If negotiation fails, disputes shall be resolved through binding arbitration
• Arbitration shall be conducted in Baku, Azerbaijan
• Each party bears their own costs unless otherwise awarded

16.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ANYSTAT.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

17.4 Assignment

You may not assign these Terms. We may assign them to any successor or affiliate.

17.5 Force Majeure

We are not liable for failures caused by circumstances beyond our reasonable control (natural disasters, wars, pandemics, etc.).

17.6 Export Compliance

You agree to comply with all export and import laws regarding use of the Service.
